Spring were appointed by a landlord property company to advise on prosecuting its terminal dilapidations claim.
The head tenant had sub let the property and further sub under lettings had occurred. Maintenance had been poor and the air conditioning needed to be replaced. We advised on a forensic approach to assembling evidence for the claim. Due to the context and initial response from the tenant, the landlord made an early and – it transpired - well judged formal settlement proposal. The landlord achieved a reasonable settlement and put itself in the best position it could do recover the legal costs it needed to expend to conclude a settlement at an appropriate level.
